INTEGRITES successfully represented the interests of the Ukrainian state-owned enterprise “Ukrkhimtransamiak”, one of the world’s major operators of ammonia pipelines, in arbitration before the International Commercial Arbitration Court at the Ukrainian Chamber of Commerce and Industry (ICAC) against PJSC “Togliattiazot”, a Russian chemical giant, the world’s largest ammonia producer.
Ukrkhimtransamiak commenced arbitration to recover the debt of Togliattiazot for transportation of ammonia through the territory of Ukraine. The opponent fiercely resisted the claim, including by raising the jurisdictional objections to ICAC’s jurisdiction.
INTEGRITES team successfully refuted all defences. The arbitral tribunal granted in full the claims for recovery of the main debt and of the default interest, as well as partially recovered our client’s legal costs.
It is a new episode of the five-year long legal battle between Ukrkhimtransamiak and Togliattiazot arising out of the long-term contract for the transit of ammonia. It included a number of prior arbitrations concerning revisions of transit tariffs, in which INTEGRITES helped the client to prevail.
