Career

Rajeev Sharma Fokeer is an Avocat à la Cour (Paris Bar) and barrister (England & Wales). He was also admitted to the Bar of Mauritius, his native country.

Partner since 2010, Rajeev’s work is essentially international in nature. He is lead counsel to French, multinational and foreign clients especially in matters involving a wide range of complex cross-border commercial issues.

With the benefit of his Anglo-French legal training and diverse cultural background, Rajeev has extensive experience in both institutional (ICC, LCIA) and ad hoc international commercial arbitration, his preferred area of practice. He has acquired strong expertise in the field having acted as counsel in over 50 commercial arbitrations. More recently, he was appointed as arbitrator in a MARC arbitration. Rajeev is also listed on the international panel of arbitrators of the Arbitration Foundation of Southern Africa (AFSA).

He has also been involved in international transactional and corporate restructuring (including the Eurotunnel sauvegarde process and Nortel global sale of assets). Rajeev's experience notably includes international disputes before various French and European Courts (ECJ, ECHR). He has further gained in-depth expertise in World Bank investigations and sanctions.

Having developed a keen interest in the fate of impoverished parties in arbitration, in 2022, he obtained a professional master’s degree in Administration and Liquidation of Distressed Companies (“ALED”), Paris Institute of Legal Studies (University of Paris I Panthéon-Sorbonne). During his master's degree, he wrote a dissertation paper on arbitration awards against French insolvent parties.

His recent publications include “The starting point of arbitral proceedings involving an insolvent party: common sense prevails” (Bulletin Joly des Entreprises en difficulté) and “Compensation for complex flights: European protection extended further and further”.

He is a member of Lincoln’s Inn, the Association Française d’Arbitrage and the Advisory Board of the Arbitration and Mediation Center of the International Chambre of Commerce of Mauritius (MARC).

Education

Rajeev holds an honours degree in English law (King’s College, London) and a maîtrise degree in French Law (Université de Paris I Panthéon Sorbonne). He also holds a French master’s degree in Law with the option Litigation, Arbitration & Alternative Dispute Resolution (Université Paris II Panthéon-Assas).
