Markus is registered as a lawyer in the list of lawyers at the Vienna Bar Association since 2001. As of 2011 Markus joined SAXINGER as a partner. Markus is author of publications on antitrust, arbitration and foreign trade law.

Markus P. Fellner is head of the dispute resolution team in Vienna. He is specialized in international commercial arbitration and litigation where he acts as counsel as well as arbitrator. Equally adept representing clients in major arbitrations and litigation, Markus’ extensive knowledge of sophisticated cross-border matters makes him a go-to Austrian disputes lawyer for leading domestic and international companies alike.

His current caseload includes some of the most complex and highest value ongoing instructions in the country.

Markus offers extensive know-how in large-scale construction projects, able to assist clients at all stages (including post-completion disputes). He has represented companies in the construction and engineering, energy, infrastructure, medical devices, logistics and automotive sectors as well as after M&A transactions.

Markus is also an arbitrator and listed in the List of Practitioners in International Arbitration at the Vienna International Arbitral Centre (VIAC) and conducted proceedings according to the Rules of VIAC, the International Chamber of Commerce (ICC), the German Institution of Arbitration (DIS) and the UNCITRAL Rules as well as ad hoc proceedings. He is also a member of the ICC Commission on Arbitration and ADR and active in the ICC Task Force on "Maximizing the Probative Value of Witness Evidence“.

Further, Markus P. Fellner focuses on antitrust and competition law. In antitrust proceedings Markus represents his clients in proceedings before Austrian and European competition authorities, such as the European Court of Justice (ECJ). Merger filings and consultations in relation to cartels and abuse of a dominant position are equally in Markus’ work-focus as well as compliance trainings directly in the clients’ headquarters. In this regard, Markus is an active member of the ICC Competition Commission and its Task Forces Competition Cartels & Leniency and Court Proceedings in Antitrust Damages Claims.

Furthermore, Markus possesses extensive expertise in setting up distribution structures, such as international franchise systems and joint ventures.

Education

After completing his law degree at the University of Vienna (Mag. iur.) in 1994, Markus P. Fellner studied European law and European antitrust law at Kings College and Queen Mary University in London where he earned his LL.M. in 1996.
