Position

Tim is an experienced property lawyer dealing primarily with site acquisitions, site assembly, property development work and the negotiation of planning agreements.

Tim’s experience covers the full spectrum of development and commercial property matters and he is particularly well known for the extensive work that he has carried out for the house building industry.

Some of Tim’s work highlights include:

Acquisition of various large Greenfield development sites across London and the South East involving complex negotiations and drafting (including multi-layered overage provisions, security packages and purchase price adjustment mechanisms). Land values ranging from £10m-£40m.

Purchase of a large development site in Twickenham for £13m and advising on a wide range of complex title issues including the enforceability of restrictive covenants and unregistered land title issues.

Purchase of a £8m site in central London and the sub-sale of this site for £15m once planning permission had been granted. Advising extensively on rights of light issues.

Sale of various Affordable Housing schemes on both a Golden Brick and Turnkey basis.

Advising on various Planning Agreements involving complex viability drafting, development obligations and development constraints.

The Southampton based team at Foot Anstey is co-headed by Tim Wheen and Carol Phillips. Specialising in property development, Wheen regularly advises housebuilders on the acquisitions and disposals of residential development schemes, and Phillips is skilled in handling matters within the retail and leisure sectors.
