Ilyashev & Partners Initiates Review of Anti-Dumping Measures on Cement Imports from the Russian Federation, Belarus and Moldova
Ilyashev & Partners’ International Trade team under the supervision of Partner Olena Omelchenko initiated the reconsideration of anti-dumping measures on imports of cement from the Russian Federation, the Republic of Belarus and the Republic of Moldova into Ukraine.
Ilyashev & Partners' team initiated the review by the Interdepartmental Commission on International Trade (ICIT) on behalf of national cement producers in light of the expiration of anti-dumping measures in June 2024.
In 2019, the ICIT imposed anti-dumping duties on cement imports into Ukraine following a complaint filed by Ilyashev & Partners Law Firm on behalf of Ukrainian domestic cement producers.
"For Ukrainian enterprises, this Commission decision is very important, – Olena Omelchenko noted. – Due to the ICIT's decision to reconsider antidumping measures, duty applications were extended and dumped imports were prevented from entering the marketplace until a final decision is taken. In general, such a process can last up to one year."
In 2019, Ilyashev & Partners International Trade team proved the presence of unfair competition on the part of the Russian Federation, Belarus, Moldova and managed to achieve an extremely rare result – simultaneous application of high duty rates on imports from the three countries. According to the results of the investigation, on 21 May 2019, the ICIT decided to apply anti-dumping duties on imports of cement into Ukraine, in particular, cement clinkers and Portland cement, which are classified under the Ukrainian Classification of Goods for Foreign Economic Activity (UCGFEA) codes 2523 10 00 00, 2523 29 00 00. The rate of the final antidumping duty is set at 57.03% for products from Belarus, 114.95% – for products from Russian Federation, 94.46% – for products from Moldova.
