In the meantime,as the annulment talks have ended client became more comfortable for a settlement and sides agreed on a deed. We are also representing Canadian Export Bank, Fin, Belgium based Export Credit Agency and Banks before Commercialand Administrative Courts for recovering their loss on revoked Turkish Bank “AsyaKatılımBankası”, which is associated with the religious and political movement accused to be the perpetrator of coup attempt in 2016. Bank has been bankrupted and our client’s claims have been partially rejected. Due to political nature of the conflict, we are also showing effort for our clients to set up meetings and contact with the bureaucraticor politic authorities.
In addition to the enforcement proceedings, we also have followed up major cases on IP matters in Turkey. We have represented one of the most global leading companiesin contentious matters before Turkish Patent Office where we have successfully achieved to obtain the registration of its well-known trademark. Furthermore, we have filed for several court actions in the name of the client for the cancellation of the third party applications that can be considered as confusingly similar to the client’s trademark in visual, audial and semantic aspects. Through the subject actions, we have managed to obtain afavourable outcome where the similar trademark application is cancelled and we have managed to protect the client’s well-known trademark and branded products within the Turkish market.
We have representedone of the world’s most specialized private entities that carries out research and development for strawberry plants, apple and pear tree and rootstock and its Turkish licensee in litigation, based on registered plant breeders rights. Through the subject court action, we successfully represented our clients against an agricultural company in Turkey requesting for the determination and prevention of plant breeder’s infringement and unfair competition and the moral & material damages thereof. This is a landmark decision on plant variety claims since it has become a precedent decision asit is the first time in Turkey that anIP Court has decided on compensation to be given to the plaintiff due to the breeder’s rights infringement and unfair competition.
