Career
Elizabeth joined the Court of Protection department at Irwin Mitchell in November 2007 and is a Partner based in the Sheffield office.
She specialises in identifying and dealing with the best possible legal structure within which personal injury and clinical negligence damages can be managed, either through the medium of a Court of Protection Deputyship or a personal injury trust.
She advises clients in relation to making applications to the Court of Protection including property and affairs deputyships, discharge of deputyships, review of orders, Statutory Wills, gifts on behalf of incapacitated individuals, establishment and administration of trusts and obtaining authority for specific acts.
She also provides clients with advice and assistance on Lasting Powers of Attorney, Enduring Powers of Attorney, and the use of personal injury trusts to protect entitlement to means tested benefits and the establishment of children’s trusts for those who receive a compensation payment before they reach 18 years of age.
In addition, Elizabeth had joint conduct of the precedent setting case of Niall Baker v H and The Official Solicitor to the Senior Courts of England and Wales (colloquially referred to as Re H) which established the principals on which the Deputy’s security bond is to be assessed.
