Anneka Dalton works in the Brands team within the firm’s Intellectual Property (IP) practice. Anneka has a common-sense approach and provides commercially minded and practical solutions to complex legal problems. She advises clients on every aspect of brand strategy, including the development, protection, exploitation, and enforcement of intellectual property rights.
Anneka’s principal areas of comprehensive knowledge lie in trademarks (including trademark litigation in particular) and domain names, and she has a special interest in IP issues relating to e-commerce and intermediary service providers, which present ever-more complex challenges to increasingly numerous online commercial operators as online activity continues to outpace the legal framework which predated it. By way of example, she recently acted for a major online retailer in its appeal to the Court of Appeal of a trademark infringement case brought by Lush in relation to Amazon’s online search function. She recently acted for a global fast-moving consumer goodsbrand in trademark infringement proceedings issued in the Intellectual Property Enterprise Court.
Anneka’s litigation and disputes experience is broad, encompassing more general commercial disputes as well as those with a strict IP focus. These include a commercial licensing dispute for a Financial Times Stock Exchange 100 company, acting for a pharmaceuticals client in a US$100 million claim against a supplier for economic duress, breach of contract, the tort of intimidation, and unlawful means conspiracy, and a breach of contract dispute in the High Court for a major online retailer. She is also a solicitor-advocate, with higher rights of audience in the English Courts. Clients appreciate Anneka’s client-focused, lateral-thinking approach to tackling their problems.
