Teh Eng Lay has been in active practice since 2001. He handles a variety of arbitration and litigation cases involving commercial and contractual disputes, administrative and public law, land development and planning law, land acquisition, land transactions and land related disputes, construction arbitrations and adjudications, and employment disputes.

Civil Litigation and Arbitration

Contractual disputes (e.g. commercial agreement, performance bond, tenancy, sale and purchase agreement) Tortious claims (e.g. conspiracy, misrepresentation and fraud, negligence, trespass, nuisance and property damage claims, inducing breach of contract and economic torts, knowing receipt, dishonest assistance and breach of fiduciary duty, and breach of statutory duty and statutory torts) Construction disputes (e.g. liquidated and ascertained damages claims, retention funds and defect liability, and final account claims) Corporate disputes (e.g. fraudulent trading and directors’ duties) Insolvency proceedings Execution proceedings Judicial Review and Appeal on employment and industrial practices

Land-based Litigation and Land Development and Planning Disputes

Land Fraud Appeals / Applications under the National Land Code 1965 in respect of quit rent, land boundaries, conditions of title, rectification of title and issuance of title, removal of caveat and etc. Judicial Review of Decision of the State Authority Appeals at the Town & Country Planning Appeal Board and Judicial Review of the Decision of the Planning Authority / Appeal Board Judicial Review of Decision of public authorities in respect of strata title and strata management

He has authored the chapter on Malaysia in the first edition of Global Legal Insights - Employment & Labour Law, published by Global Legal Group Ltd. London.
