Legal PI/IT - Paris

Position

Patrick is a partner at KPMG Avocats. He co-heads the IP/IT compliance department.

Patrick advises national and international corporations, as well as public sector entities on complex IT projects.

His expertise is significant in advising clients who encounter IT projects issues and provides valuable guidance on post-contractual restructuring, settlement, take-over and follow up. This includes specific focus on privacy and data protection undertakings, subcontracts and data processing and sub processing agreements, restitution of data post termination.

Knowing how projects may go wrong, he is key for anticipating risks while drafting and negotiating IT agreements, for a wide range of clients from SMEs, start-ups, investment funds and public sector entities.

Patrick assists regulatory bodies and large private groups on infrastructure projects in areas such as electronic signatures, data protection and the implementation of infrastructure contracts. He intervenes alongside international public institutions, regulatory bodies or international associations to provide trainings regarding national and international legislation on protection of personal data or electronic transactions. He has been appointed for such activities in African countries.

Patrick is also involved in the due diligence and internal audits conducted on the IP rights, commercial contracts and data protection compliance in order to identify and quantify risks. Based on his long-lasting experience of the IT sector, Patrick includes recommendations and best practices (eg: eSCM, ITIL, CMMI) in his reports in order to address the identified risks.

Patrick assists its clients in the defense of complex IT litigations both on the technical aspects, specific software and contractual disputes.

Patrick participated in the creation of a NF standard on the GDPR Compliance of software (NF552).

Education

Patrick is an Attorney at Law, member of the Hauts-de Seine Bar.

He holds a PhD in Computer and Business Law from the University of Toulouse I.
