Career
Tom specialises in high value, complex litigation, especially in the shipbuilding, superyacht and offshore construction sectors. Tom is one of the go to litigation lawyers for three of the largest shipbuilders in the world, based in South Korea, and at one point recently was handling 75% of all cases for Samsung Heavy Industries. He led the team for SHI in a major 6 week hearing concerning the cancellation of an offshore semi-submersible drilling rig, with claims worth over US$ 500 million. He is also currently acting in a warranty dispute for two prototype KC-1 LNG carriers worth over US$ 400 million.
Tom is also regularly instructed by other large shipbuilders, including European yards specialising in Superyacht/Megayacht or Explorer Yacht construction – and had advised on contracts as well as disputes arising out of difficulties due to the Covid 19 pandemic. Tom advised the yard throughout the build of the largest sail assisted motor yacht in the world, at over 140m, including through 6 weeks of arbitration (on separate issues) and arresting the Yacht in Gibraltar.
Tom has also acted for shipyards in some of the leading High Court decisions in the industry, such as “The Star Polaris” on shipbuilding warranty claims and “Adyard v SD Marine” on project delay. He represented the shipyard in Valla Yachts v Nobiskrug concerning payment of subcontractors (which formed part of a much larger dispute).
