Position

Elliot is a Partner of the firms and leads the Employment Department at Branch Austin.

Elliot is a seasoned litigator in the employment field, able to represent high profile clients in the Employment Tribunal, the Employment Appeal Tribunal, High Court and Court of Appeal. Elliot’s legal practice consists of all manner of Equality Act claims (discrimination, victimisation, harassment, equal pay etc) and whistleblowing claims including automatic unfair dismissal and detriment claims.

He has experience acting for and against high profile parties including political parties, international banks, hedge funds and NHS Trusts.

He is also often instructed in commercial litigation matters, notably in the food & beverage industry.

Elliot is also a New York attorney-at-law, previously being principal lecturer for a New York Bar Review company.

Notable Work:

Successfully representing Sonia Appleby in her whistleblowing claim against The Tavistock and Portman NHS Trust September 2021 The Times Lawyer of the Week in September 2021. Lawyer in the News in the Law Society Gazette September 2021. Successfully represented a fellow solicitor at trial in her Equal Pay and Sex Discrimination / Harassment trial – August 2021 Successfully overturned a “manifestly wrong” Employment Appeal Tribunal precedent, reviving the concept of Constructive Harassment Dismissal (EA-2020-000876-LA and EA-2020-000877) in July 2021. Successfully represented several clients at trial against RVA Surveyors Ltd leading to RVA being debated in Westminster Hall as reported in Hansard in May 2021. Successfully clarified the law on the distinction between the test for unfair dismissal and wrongful dismissal (Don-Pevi v Royal Mail Group Ltd UKEAT/0232/15/DA) in January 2016.
