Career

Anu Monga has around 17 years of experience in advising clients on various aspects of Competition and International Trade/ WTO laws. She also works on issues in Technology, Media & Digital Communications space and assists clients on litigation matters before courts/ tribunals in India and overseas.

She advises foreign, multinational and Indian corporate clients across sectors including healthcare and pharmaceuticals, automobile, chemicals and fertilizers, aviation, manufacturing, steel, cement, telecommunications, broadcasting, information technology, power, insurance and real-estate.

Anu advises clients on behavioural and adversarial matters, merger control and general compliance, including audit and training. Additionally, she has a thorough understanding of competition economics and assists clients on competition economics analysis.

Anu’s International Trade practice involves advising and representing stakeholders on trade matters before anti-dumping and CVD authorities. In particular, she advises clients on WTO law, free trade agreements and assists clients in their understanding of the impact of changes in free trade agreements and other bilateral trade agreements. She has argued trade dispute matter before the US Department of Commerce on behalf of the Government of India.

Anu actively advises and opines on barriers to entry, which include foreign investment regulations, policies and commitments under various trade agreements, customs duty etc. She takes part in consultation processes with Government of India and related ministries on policy related issues and submits proposal, papers on required changes in the extant policy.

Professional Experience:

Antitrust/ Competition

φ Represented the Informant in the cement cartel matter and obtained the landmark order from CCI imposing a penalty of INR 67 billion (on 12 Cement Manufacturers).

φ  Obtained landmark judgment from the Supreme Court of India on “imposition of penalty on the basis of relevant turnover” (Excel Crop Care Ltd. v CCI): 2017

φ Obtained the landmark order from the High Court of Delhi directing CCI to decide the issue of jurisdiction first before going on merits of the case (Delhi Development Authority v CCI): 2014

φ First order by CCI granting cross examination of Informant and witnesses (Maruti & Co. v Karnataka Chemists & Druggist Association of India): 2013

φ Advised and assisted the Department of Investment and Public Asset Management (DIPAM), Government of India and HPCL in HPCL-ONGC Merger and assisted the Government of India in issuing the exemption notification for Central Public Sector Enterprises from obtaining merger approval from CCI (2018).

φ Advised and assisted RECL in PFC-RECL Merger and represented RECL before the CCI.

φ Assisting a multi-national company in antitrust issue in South Asia Region.

International Trade & WTO

φ Advised Government of India on trade negotiations with UK (during BREXIT)

φ Appeared before the US Department of Commerce on behalf of Government of India in a CVD investigation and presented arguments in the matter (in person appearance).

φ Assisting a multi-national company in a South Asian country on a trade-related issue.
