Amy Kallal

Career

Amy J. Kallal is a partner at Mound Cotton. She has over twenty years of experience in all aspects of complex litigation and arbitration. She has arbitrated dozens of high-stakes reinsurance disputes to final award and has litigated a variety of cases in state and federal courts. Amy also provides advice to clients in third-party direct insurance matters.

Amy serves as the Director of the firm’s Diversity Equity & Inclusion Committee.

Representative Matters Representing insurer in coverage action seeking recoveries for close to 1,000 lawsuits arising from exposure to ethylene oxide. Advising reinsurers on a wide variety of issues arising under large loss portfolio transfer agreements, including collateral, warranties, and subject business. Providing coverage advice to direct insurers relating to sexual abuse claims and construction defect claims under wrap-up programs. Represented ceding companies in a “lost policy” dispute and an arbitration seeking coverage under reinsurance treaties for asbestos claims. Represented surety company in an arbitration involving construction bonds written by a managing general agent that became insolvent. Represented reinsurer in dispute involving cession of lead paint claims involving complex occurrence and allocation issues and bad faith. Represented ceding companies and reinsurers in over 30 arbitrations involving underwriting issues, allocation and aggregation of losses, coverage under quota share, excess of loss, catastrophe, and facultative contracts, financial solvency, commutation, bad faith, fraud and rescission claims, pre-answer security and letters of credit, audit rights, and notice issues. Represented clients in coverage disputes under Bermuda forms. Advised start-up company on reinsurance contract wording.
