Emmelie Wijckmans

Faros

Emmelie is partner within Faros, handling EU and domestic competition law matters. She heads the abuse of dominance, horizontal agreements and cartels practice within Faros. Her experience further extends to merger control and distribution agreements in which areas she frequently assists clients. She was/is involved in – among others – a number of (ongoing) investigations on both the EU and the Belgian level in respect of Articles 101 and 102 TFEU (and the Belgian equivalents) and merger control proceedings, and provides high-level strategic advice on complex matters, including on collaboration projects with competitors, rebate schemes and information exchanges. Emmelie is a trainer within the compliance team of Faros. In this context, she also develops tailor-made competition law compliance trainings for Belgian and international businesses. Emmelie regularly publishes in the field of competition law. One of her latest publications is a practical handbook (377 p.) on Belgian competition law in the “Bos door de bomen” series of which she is a co-author. Her most recent publication is "Horizontal Agreements - Block Exemptions & Horizontal Guidelines - Toolbook for Practitioners" (LeA Publishers) on the revised Horizontal Block Exemption Regulations on R&D and Specialisation agreements (‘HBERs') and the revised 2023 Horizontal Guidelines. She wrote this book together with Faros partners Frank Wijckmans, Maaike Visser and Karolien Francken and with Faros Associate Annemie Van de Vliet and Faros consultant Morgane Smets. This book contains the new legislation with indications of key words in bold, as well as a practical Q&A. In addition to her competition law practice, Emmelie advises clients on general business law matters, and practices general litigation, with a particular focus on arbitration. Emmelie has particular expertise in the retail sector, as well as in media, IT and pharma.

Frank  Wijckmans

Frank Wijckmans

Faros

Frank is senior partner within Faros, handling EU and domestic competition law matters. He handled some of the most notorious cases both at EU level (such as Akzo predatory pricing; Tractors on information exchange; Volvo/Renault and Volvo/Scania on merger control; Trucks on cartels) and the Belgian domestic level (such as Honda on abuse of dominance; Supermarkets on hub and spoke cartels; White Star in the sports field; Kinepolis on remedies in merger control; Volvo/Kant on merger control). Frank acted as expert advisor to DG Competition of the EC regarding the new EU competition law regime on vertical agreements. His report was published on the DG Competition website. Frank is assessor at the BCA (appointed in that position by the Belgian government in February 2022). Frank is professor at the Brussels School of Competition (LL.M.), where he teaches the “Law and Economics of Vertical Restraints”. He is author of leading monographs such as “Vertical Agreements in EU Competition Law” which is in its third and soon fourth edition and is published by Oxford University Press. His most recent publication is "Horizontal Agreements - Block Exemptions & Horizontal Guidelines - Toolbook for Practitioners" (LeA Publishers) on the revised Horizontal Block Exemption Regulations on R&D and Specialisation agreements (‘HBERs') and the revised 2023 Horizontal Guidelines. In addition to his competition law practice, Frank has extensive experience in arbitration. He has been designated arbitrator in several ICC, Cepani and ad hoc arbitrations. He has acted as an expert witness on competition matters in arbitration proceedings. He is teaching a workshop on arbitration and competition law at the Brussels School of Competition.

Karolien Francken

Faros

Karolien is partner within Faros, where she is the driving force behind Faros’ innovative compliance practice. Karolien assists Belgian and international clients with various compliance matters. She has extensive practical experience in developing tailor-made compliance programs and providing hands-on trainings to legal teams and sales teams throughout Europe. In addition to her compliance law practice, Karolien has broad experience in competition law, including private damages litigation. She was involved in – among others – investigations on the EU level in respect of Article 101 TFEU and follow-on private litigation (including Trucks). Karolien was involved in EU and Belgian merger control proceedings and provided high-level strategic advice on complex matters such as comprehensive joint purchasing arrangements, collaboration projects with competitors & information exchanges and the set-up and roll-out of European selective distribution systems. She has extensive sector expertise in the retail sector, FMCG sector and the automotive sector. Karolien regularly publishes in the field of competition law. In 2022, she pulished a practical toolbook in response to the publication of Regulation 2022/720 and the 2022 Vertical Guidelines, which she wrote together with Faros partner Frank Wijckmans. Her most recent publication is "Horizontal Agreements - Block Exemptions & Horizontal Guidelines - Toolbook for Practitioners" (LeA Publishers) on the revised Horizontal Block Exemption Regulations on R&D and Specialisation agreements (‘HBERs') and the revised 2023 Horizontal Guidelines. Maaike Visser

Faros

Maaike is partner within Faros, handling EU and domestic competition law matters. She heads the merger control practice within Faros. Furthermore, she also has extensive experience related to cartel investigations and private damages litigation. She was involved in – among others – Trucks on cartels. Maaike contributes to publications on competition law and co-authored an important publication on the EU Private Damages Directive – Practical Insights (Intersentia, 2016). Her most recent publication is "Horizontal Agreements - Block Exemptions & Horizontal Guidelines - Toolbook for Practitioners" (LeA Publishers) on the revised Horizontal Block Exemption Regulations on R&D and Specialisation agreements (‘HBERs') and the revised 2023 Horizontal Guidelines. She wrote this book together with Faros partners Emmelie Wijckmans, Frank Wijckmans and Karolien Francken and with Faros Associate Annemie Van de Vliet and Faros consultant Morgane Smets.
