Ayşe Selcen Özcan is a senior associate at Cetinel Law Firm.

Career

As of June 2016, upon completing her legal internship, Ayşe Selcen Özcan became a licensed attorney registered at Istanbul Bar Association and started working at Cetinel Law Firm in August 2016.

She takes part in international arbitration, investment arbitration and dispute adjudication board (DAB) procedures and focuses on international construction projects on aspects of contract management and pre-contract risk analysis.

She represents and advises contractors of various nationalities in cases or projects in Europe, Middle East and Turkic Countries. She acted as party representative and tribunal secretary in matters conducted under the rules of institutions such as ICC, PCA, ISTAC.

She contributed to International Construction Law, Second Edition, edited by Lukas Klee. She is one of the authors of the Turkish chapter in Compendium Project funded by Society of Construction Law Australia and supported by Melbourne University.

Selective Work Experience on Construction and Dispute Resolution

Tender documentation reviews and risk analysis on FIDIC based and other types of construction contracts. Drafting and revision of diverse types of contracts and agreements. Country risk analysis for international clients investing in international tenders e.g. railway and dam projects. Legal assistance in the negotiation and implementation phases of contracts in various construction projects. Legal research and drafting of legal opinions on a wide range of topics regarding Turkish law subjects including contract law and corporate law, international law and international dispute resolution. Dispute resolution experience in every phase of international commercial arbitration, international investment arbitration and dispute adjudication boards including due diligence phases, interim injunctions, preparing claim documents, submission drafting, document production process, witness statements, enforcement of the award and setting aside procedures.

Consultancy

Regular contract management for various petrochemical industry plant projects of a Turkish construction company in Turkey, Azerbaijan, and Russia. Advising an Italian construction company by providing risk analyses regarding various in its FIDIC based tenders in Turkey, Australia, Namibia, Sierra Leone, consultancy in contract negotiations and preparation of submissions of the company in Dispute Board proceedings in different countries. Tender reviews for a Turkish construction company in various countries including Azerbaijan, Russia, Serbia, and Saudi Arabia. Advising a Turkish construction company with regards to various types of contracts including procurement contracts, NDAs, freight contracts and bank guarantees. Handling various project finance and third-party litigation funding related matters. Disputes Tribunal Secretary in an arbitration between a Romanian company and the Romanian Ministry of Health with relation to a construction agreement (ICC Arbitration Case). Member of counsel team of a multinational construction company for its claims against the Employer in a pipeline and central processing facility construction project in Tunisia (ICC Arbitration case). Assisting the President of an arbitral tribunal consisting of three arbitrators. The case was an ICC Case in a dispute arising out of a Subcontract between two Qatari companies. The dispute has been settled. Member of counsel team of a Turkish contractor for its claims against the Cameroonian employer of a housing and shopping mall construction project (ICC Arbitration Case). Member of counsel team of a Turkish construction company for its construction claims against a Turkish contractor (Arbitration under the rules of Union of Chambers and Commodity Exchanges of Turkey (TOBB)). Member of counsel team of Turkish investors for their claims against State of Libya under two investment treaties (ICC Arbitration Case). Member of counsel team of a Turkish construction company for its construction claims against a Saudi Arabian company under their joint venture agreement executed with relation to an oil and gas plant construction project in Saudi Arabia (ICC Arbitration Case). Member of counsel team of a Turkish coal processing company for its claims against an Austrian company (ICC Arbitration Case). Assisting to a DB member in the dispute adjudication board process in a PPP hospital reconstruction project in Turkey. Member of counsel team of a Turkish branch of a UAE pharmaceutical company for its construction claims against a French pharmaceutical company (ICC Arbitration Case).

Education

Ayse Selcen Ozcan graduated from Ankara University Faculty of Law in 2013 and obtained an LL.M. degree in European Law from Leiden University, the Netherlands in 2014 as a Jean Monnet Scholar of 2013-2014. She has obtained her second LL.M. degree in the field of dispute resolutions in International Law in Public Law LL.M. programme at Galatasaray University in 2019.
