Notable cases

  1. The firm acted for ASM Technology Singapore Pte Ltd in relation to infringement claim relating to auto-molding machines used to package semi-conductor chips. The matter involves probably the largest patent infringement quantum claim ever in Singapore, USD103 million. Director Daniel Lim led the litigation. The liability trial went up to the Court of Appeal. The matter is proceeding in the High Court with complex damages issues. 4 decisions in this litigation have been made public: Towa Corporation v ASM Technology Singapore Pte Ltd and anor [2014] SGHCR 16; Towa Corp v ASM Technology Singapore Pte Ltd and another [2015] SGHCR 4; Towa Corp v ASM Technology Singapore Pte Ltd and another [2017] 3 SLR 771; and ASM Technology Singapore Pte Ltd v Towa Corp [2018] 1 SLR 211.
  2. Our Daniel Lim was lead counsel instructed to act for the Fuji Xerox Group of companies (now FujiFilm Group) in a rare IP infringement matter against a parallel importer. This is a rare case as Singapore’s IP laws are regarded to be permissive in relation to the exploitation of parallel imports. It also the first known case on rights management information rights under the Copyright Act.
  3. The firm represented PUBG Corporation against Garena International Pte Ltd and others in litigation and arbitration in a copyright infringement matter. This led to a reported case, PUBG Corp v Garena International I Pte Ltd and others [2020] SGCA 51 – which clarified court case management principles on whether to order a stay of proceedings when there is an ancillary arbitration. Director Daniel Lim led the litigation.
  4. The firm co-ordinates and executes advisory on cross border multi-jurisdictional review of regulatory and legal matters relating to e-commerce platforms for Rakuten Group Inc. Advice spanned territories across Asia, ANZ, EU, and USA. Areas included data protection / data privacy, on-line sector regulatory compliance, business licensing for on-line platforms. Director Jeffrey Lim led the reviews.

Review of regulatory and legal issues relating to data privacy / data protection, in a regional review including for launch of healthtec product and for establishment of multi-jurisdictional corporate framework for data privacy / data protection compliance programmes.
