Career
Sudhinder holds expertise of over 30 years in different areas of legal practice, including indirect taxation, contracts, competition law, foreign trade laws, anti-dumping laws, corporate, constitutional and administrative laws.
Sudhinder also has extensive experience in general litigation and arbitration matters. He has appeared and argued matters in various fora including the Supreme Court of India, various High Courts in India, Customs Excise Service Tax Appellate Tribunal, Competition Commission of India, Competition Appellate Tribunal, National Company Law Tribunal, National Company Law Appellate Tribunal, National Consumer Disputes Redressal Commission, erstwhile Company Law Board, DGFT Authorities, other quasi-judicial authorities and departmental officers and in arbitration proceedings.
Sudhinder was admitted to the Bar in 1989. Before joining the Firm in 2007, Sudhinder practiced law as an independent counsel and also, holds experience of working as a junior Advocate under Mr. A.N. Haksar, Bar-at-Law, Senior Advocate, Supreme Court of India.
Select Professional Experience
Represented the erstwhile HDFC Limited (since merged with HDFC Bank) before the Supreme Court, against IL&FS. Advised the committee of creditors in the insolvency resolution process of Binani Cements Limited insolvency under the Insolvency and Bankruptcy Code, 2016. Advised the Resolution Professional and liquidator in the insolvency and liquidation proceedings of Concast Steel & Power Limited. Succeeded in defending Talluri Srinivas and S. Gopalakrishnan, the Ex-partners of PWC in the Satyam scam before the Securities Appellate Tribunal. The Satyam scam was the first corporate fraud by the Satyam Management and the Auditors were proceeded against for complicity and wilful gross negligence. A clean chit by Tribunal has vindicated the stance of the Auditors that were themselves victim of a well-orchestrated fraud. Representing a major Indian engineering company involved in energy and environment in several high-stake arbitrations. Successfully defended one of the largest producers of edible oil in a Cartel Enquiry by Competition Commission of India. The enquiry was into the alleged cartelisation in the futures market. The allegation was circular bidding on the commodities exchange, thereby rigging the prices. Acted on behalf of Industrial Laminates (India) Private Limited and its individuals Mr. Virender Singh Negi and Mr. Saleh Najmuddin Mithiborwala before the Competition Commission of India. Appeared on behalf of a regulatory body under the jurisdiction of Ministry of Finance, Government of India before the Constitution Bench in a case relating infringement of fundamental rights and data privacy. Appeared in a tax matter before the Supreme Court which had a huge impact on availment Input Tax Credit in case of exempted final products.Memberships
