Courtney Rothery helps clients to understand and resolve their construction disputes.

Construction disputes can involve a minefield of legal, contractual, procedural and technical issues which even the most seasoned contractor or employer can struggle to fully understand and keep on top of. Courtney is able to assist clients by quickly identifying the important issues in large and complex construction disputes and provide clear advice on the best strategy to resolve disputes as quickly and effectively as possible.

Courtney can explain the strengths and weaknesses of a client's claim or defence in plain English. She can also help clients put forward their case in a way which can be easily understood by the other side. All too often parties dismiss their opponent's case because they don't really understand what it is about and therefore whether it is valid. In order to resolve disputes and avoid arbitration a case must be clearly and forcefully presented to the other side from at outset. Courtney can assist clients in presenting their claims (and defences) in the best light so that they are given a strong platform for settlement discussions.

Where arbitration is the only option Courtney is able to steer clients through the rules and procedures for domestic arbitrations under the rules of the Dubai International Arbitration Centre (DIAC), the Dubai International Financial Centre - London Court of International Arbitration (DIFC LCIA), the Abu Dhabi Commercial, Conciliation and Arbitration Centre (ADCCAC) and international arbitrations under the Rules of Arbitration of the International Chamber of Commerce. Courtney also has experience of ad hoc (i.e. non-institutional) arbitrations.

Courtney is experienced in the common mistakes made in arbitrations both domestic and international and can therefore advise clients on how to avoid them. She can provide a straightforward overview of the arbitral process so that clients who have not been involved in an arbitration from start to finish, either at all or for some time, know what to expect.

Highlight

Successfully securing a final award in a DIAC arbitration on behalf of an international contracting client. Courtney represented the claimant whose claims were vigorously defended by the respondent, who also counterclaimed.

The case involved a number of interim applications and concluded with a five-day hearing which was held in Dubai where both parties were represented by leading Queen's Counsel. The claimant was successful in all of its claims and was awarded sums in respect of prolongation costs, variations, retention, interest and a significant sum in respect of legal costs.

The client was very pleased with the final award and there is nothing more important than a very pleased client.
