I advise both public and private sector clients in relation to all forms of Scottish disputes or those which potentially Scottish arm.

My joined up approach with colleagues means that I often provide advice to clients at early stages and even contract/agreement formulation. Early intervention can be an invaluable tool in limiting a clients exposure to risk and cost. Where avoidance is not possible, then preparation is key. I am always on hand to provide advice in relation to protective steps which can be taken by clients who fear that a contentious issue may be in the offing.

I act in complex and high value litigations and have extensive experience of Court of Session practice and procedure including commercial contract disputes, professional negligence, petitions, caveats, actions for reduction, interim orders applications, judicial review, appeals to the Inner House and a wide range of damages actions with a particular interest in vicarious liability disputes.

I also have a substantial Sheriff Court Practice with mirroring areas to my Court of Session practice, but I also have experience leading Fatal Accident Inquiries.

As well as court experience, I regularly advise clients in relation to alternative dispute resolution, particularly mediation. When parties mediate, whether it be during the course of a lengthy litigation or in the early part of a dispute, there is a shared desire to bring the dispute to an end. That joint purpose may be one of the few issues parties are prepared to agree on – but it’s that desire to end the dispute that can drive successful resolution and broker a settlement. This would never be achievable in structured court proceedings or arbitration. Those who want a resolution on their own terms can benefit from the flexibility and pragmatism offered by mediation. This is a valuable resource, and I am always keen to ensure my clients are well informed about their options.
