Head of Family Law.

Position

Head of Family Law, advising on all areas of family law in Scotland. Accredited by the Law Society of Scotland as a specialist in family law and as a family mediator. Trained as a collaborative family lawyer and as a family arbitrator. Deals with divorce, separation, relationship breakdown, cohabitation disputes, cohabitation agreements, prenuptial and postnuptial agreements, child disputes – contact and residence of children and relocation of children.

Fiona has in-depth experience in a wide range of family law matters and is an expert in dealing with international cases.  Many such cases involve people who often think (wrongly) that they are beyond the reach of a Scottish family law firm.

Recent cases include an unjust enrichment claim brought by a surviving spouse against the estate of their late spouse.  Another case centred on an argument about where children should be schooled and whether this should be a private school; Gibson Kerr won the case.

Other notable cases include one involving an application by a mother who wished to relocate with her child to Hong Kong. Fiona represented the mother, who was successful. She also acted in the reported case Garrard v Inglis, which was a dispute about the date of separation in a cohabitation claim under s28 of the Family Law (Scotland) Act 2006.
