Career

Mark’s practice focuses on labor and employment law, and in particular ERISA and other employee benefits litigation. Mark has represented employers, as well as plans and plan fiduciaries. He has substantial experience with class actions and withdrawal liability arbitrations.  He has practiced before federal and state courts and agencies, and arbitrators and mediators. He has tried cases before judges and juries alike, as well as  administrative law judges, hearing officers and arbitrators. He has orally argued in six federal Courts of Appeal and two state Supreme Courts.  He has authored three U.S. Supreme Court amicus briefs.  Mark has spoken and written on ERISA and employee benefits law, and on litigation topics generally.

Mark is a Fellow in the College of Labor and Employment Lawyers and a Fellow in the American College of Employee Benefits Counsel.  He has been recognized as a leading lawyer for national ERISA Litigation Law in Chambers USA.  Mark was an adjunct Professor of trial advocacy at Northwestern University School of Law for 14 years, and an adjunct Professor of Practice at the University of Arizona College of Law for four years.
