Penelope Jarvis

Penelope is a Senior Associate (South African qualified) and is a Data Protection (DP), Freedom of Information (FOI) and Environmental Information Regulation (EIR) specialist. Penelope trained and qualified as an attorney at Webber Wentzel in South Africa and joined Eversheds in the middle of 2012 having previously worked at the BBC and the Olympic Delivery Authority. With nearly 5 years of in-house experience, Penelope has a unique understanding the challenges faced by companies with regard to compliance with Data Protection/Privacy and information access regimes.
Penelope has added to her valuable in-house experience by managing multi-jurisdictional data privacy projects; advising on the data protection concerns associated with staff facing data protection policies, fair collection and consent questions; data protection matters associated with employment disputes and employee monitoring; website privacy policies and other online compliance. Penelope has also advised on the Data Protection considerations associated with the use of Cloud computing technology and the collection of personal data using WiFi. Further, Penelope has assisted clients to manage ICO complaints and data security breaches.
Penelope’s expertise in relation to FOI and EIR includes providing advice on the application of exemptions and exceptions as well as providing strategic advice to clients about the scope and extent to which clients are covered by FOI and/or EIR regimes. She has also offered advice in relation to the interpretation of secondary legislation, such as Orders, issued in terms of the FOI Act. Penelope has advised clients on initial responses to requestors, as well as correspondence with the Information Commissioner’s Office (ICO) relating to complaints to the ICO. She has also acted in appeals to the First-Tier Tribunal (Information Rights).
