Ed specialises in complex contractual disputes and procurement challenges, particularly in the TMT sector.
Major cases include BT Cornwall v Cornwall Council, Cornwall Partnership NHS Foundation Trust and Peninsula Community Health CIC [2005] EWHC 3755 (Comm)) (a major IT outsourcing dispute involving relating to the termination of a contract worth circa £260m), DWF LLP v Secretary of State for Business Innovation and Skills [2014] EWCA Civ 900 (one of only a small number of procurement cases to be heard before the Court of Appeal), Covanta Energy Limited v Merseyside Waste Disposal Authority [2013] EWHC 2964 (TCC) and [2013] EWHC 2922 (TCC) (a leading procurement case involving a challenge to a decision to award a contract worth circa £1billion) and City Electrical Factors and Electrical Waste Recycling Group v Recolight and Others (HC09C04852) (a major competition claim involving four of the world’s biggest electronics companies).
IT and telecommunications disputes form the largest part of Ed’s practice. He regularly receives international and strategically important instructions in this field, including (i) software licencing disputes, (ii) outsourcing disputes, (iii) Artificial Inflation of Traffic claims (alleging breach of contract, abuse of market dominance, unjust enrichment and breach of collateral contracts), (iv) data security breaches, and (iv) global supply chain disputes. Ed also provides specialist advice on the application of regulatory requirements in the telecoms sector.
Ed is a member of the Society for Computers and Law and the Procurement Lawyers Association. Ed has experience of resolving disputes by negotiation, mediation, adjudication, arbitration, and litigation.
