Mr. Weinstein represents employers of all sizes in employment litigation and counseling. Mr. Weinstein prides himself on being a businessperson’s attorney, by providing practical legal advice that allows businesses to mitigate or respond to potential legal risk while continuing to meet their objectives. To that end, Mr. Weinstein focuses his practice on restrictive covenants and trade secret protection, employment litigation, employment advice and counseling, and federal government contractor employment compliance.
Restrictive Covenant and Trade Secret ProtectionMr. Weinstein is a one-stop-shop for any client’s restrictive covenant and trade secret needs. Mr. Weinstein regularly drafts and revises restrictive covenant, confidentiality and trade secret agreements to ensure maximum enforceability. When disputes arise, Mr. Weinstein works directly with his clients to appropriately respond to the dispute, including by exploring means of resolving matters short of litigation. Of course, when litigation is unavoidable, Mr. Weinstein’s pedigree as an experienced litigator shifts into high gear as he zealously advocates for his client’s interests.
Employment LitigationMr. Weinstein’s litigation practice includes defending against class and collective actions, general labor and employment issues, pay equity analysis and disputes, executive disputes, whistleblower claims, government contractor compliance, and wage and hour litigation as well as providing litigation avoidance strategies. Mr. Weinstein’s goal in litigation is always to find the best solution for his clients and provide practical advice and options for his clients to make informed decisions.
Employment Advice and CounselingMr. Weinstein regularly provides advice and counsel to clients on all aspects of employment law, including wage and hour practices, whistleblowers, trade secret and confidential information protection, leave policies, reductions in force, labor relations, flu vaccination policies, and FMLA and ADA compliance, and administration and inquiries related to COVID-19/post-COVID-19 plans. Mr. Weinstein’s philosophy when advising clients is simple: how can we meet the needs and goals of the business while mitigating risk? Everything Mr. Weinstein does with his clients revolves around that central question.
Federal Government Contractor Employment ComplianceMr. Weinstein also advises federal government contractors and subcontractors on unique employment, affirmative action and other compliance issues that arise in the government contracts sphere. Some examples of his work include developing and implementing policies and programs; conducting internal audits and investigations; preparing affirmative action plans; advising contractors and subcontractors with respect to all aspects of Office of Federal Contract Compliance Programs (OFCCP), Service Contract Act and Davis-Bacon Act compliance; and defending clients during OFCCP and Department of Labor audits and enforcement proceedings.
Mr. Weinstein has been invited to speak on a number of topics including restrictive covenants, trade secret protection, wage and hour compliance and pay equity and previously worked with the U.S. Department of Homeland Security in procurement and law enforcement operations.
