Career

Phyllis H. Marcus heads Hunton Andrews Kurth’s advertising counseling practice. With 17 years of prior leadership experience at the FTC, Ms. Marcus brings a unique vantagepoint to her retail, consumer products and technology clients. Her practice focuses on all aspects of advertising, from pre-acquisition diligence, initial product development, claim creation and substantiation establishment, to dissemination in digital, streaming, social media, and online gaming channels. Ms. Marcus is the foremost expert on children’s privacy in the United States, having led for many years the FTC’s children’s online privacy program, bringing COPPA penalty actions and spearheading the 2013 overhaul of the COPPA Rule. This experience provides her with a keen understanding of the Ad Tech and digital environments as they apply to children.

Ms. Marcus was recognized as a Media and Advertisement Law Trailblazer by The National Law Journal, and as one of the Top 10 Advertising Transactional and Regulatory lawyers in the U.S. by Business Today. She is a sought-after speaker on advertising and children’s privacy and has been interviewed countless times by national media outlets.
