Career
Graham is a Principal in the firm’s Toronto office and Practice Chair of the Trademarks Group, whose practice spans all aspects of trademark counselling, prosecution and litigation. He works with brand owners to build and protect their brands and reputations through trademark clearances and prosecution, as well as opposition proceedings, section 45 cancellation proceedings and section 57 expungement proceedings. He also sits on the Canadian Anti-Counterfeiting Networks Steering Committee as the firm’s representative and is the Chair of the CACN’s IPR Enforcement Working Group, a small group of lawyers and legal organizations that meet regularly with federal government and law enforcement officials to discuss Canada’s IP strategy and potential reforms to its IP laws and policies.
Graham's litigation practice covers both the Federal and provincial courts, and extends to actions and summary applications for passing off, trademark and trade-dress infringement, depreciation of goodwill and the sale, distribution and advertisement of counterfeit goods. He also has considerable experience protecting brand owner’s marks online, including across a variety of social media platforms, and has worked with clients to manage and monetize their trademark portfolios through acquisitions, assignments, and licensing and merchandising arrangements.
Graham is listed numerous national and international directories, including The Legal 500, World IP Review Leaders, Benchmark Canada, Euromoney LMG Expert Guides, World Trademark Review 1000, and Lexpert. In 2020 and 2022, he was named a Rising Star in Canada and Trademarks at the LMG Rising Star Awards. BAH and MPA (Queen's University); JD (University of Ottawa). Registered Trademark Agent.
