Career

Gustavo joined CMS Grau in 2012 and specializes in Real Estate Law and in the legal property clearance for real estate, telecommunications and hydrocarbons projects. He has experience in the elaboration of Due Diligence reports in the areas of his expertise, property title diagnosis of urban and rural real estate properties, negotiation and elaboration of contracts; and the obtaining of municipal and administrative licenses or authorizations.

Prior to joining CMS Grau, Gustavo provided services at Nokia Siemens Networks Peru S.A.C., Gas Operative Company of Amazonas S.A.C. (COGA – TgP) and the Muñíz, Ramírez, Perez – Taiman and Olaya SCRL Law Firm.

Gustavo´s main clients are those that require: (i) risk or contingency analysis of real estate properties that are going to be acquired (property or real estate rights); (ii) property clearance with the purpose to eliminate or mitigate contingencies; (iii) negotiation and subscription of the various real estate contracts, such as sale, surface, usufruct, easements, leases, donations, among others; and (iv) obtaining authorizations or licenses before several governmental entities.

Gustavo’s services allow his clients to acquire real estate properties in a secure manner and permitting them to develop their commercial activities without any contingencies arising from the acquisition of such properties, supporting them in the obtaining of licenses and/or authorizations required by law. This is possible because of a previous analysis that determines: (i) what type of real estate agreement better suits the client´s interests; (ii) the protection mechanisms that may be included in the real estate contracts; and, (iii) the compatibility of the real estate properties with the development and operation of their projects.

In the real estate field, CMS Grau demonstrates expertise in a variety of matters, including the development of real estate and urban planning projects, construction contracts, land remediation management, and preparations for leases, sales and assignments. On the finance side, the team is well versed in the negotiation of administration trust and guarantee trust contracts. Operating across the energy, infrastructure, housing and mining sectors, the group is led by the experienced Carolina Gajate, who handles housing project developments and the acquisition of rural land for the natural resources projects. At the associate level, Gustavo Atarama concentrates on legal land remediation for commercial and retail projects, while Carmen Assereto focuses on urban and rural property clearance, as well as usufruct rights and purchase options. In July 2023, former practice heads Raúl Ravina and Roberth Rojas, as well as associate Patricia Camacho, left the firm. Since publication, the office has substantially strengthened the practice group with the hire of a six-strong, specialist team (best known for its expertise in rural and agrarian real estate matters) from Rubio Leguía Normand, including partners Franco Soria (who returns to the firm he left in 2019) and Pedro Pablo Castañeda – effective as of March 2025.
