Career
Malcolm K. Montgomery is Head of the Real Estate practice, Head of the Hospitality, Leisure & Gaming Industry Group and Head of the REIT Affinity Group.
His practice spans domestic and cross-border investment and finance, and leveraged lending and bank finance for REITs and other real estate companies. He advises on workouts and restructurings of construction, permanent and mezzanine loans and credit facilities. He handles financings involving assets and currencies in multiple countries, including multi-property secured loans, mezzanine financings, term and construction financings, subscription and debt portfolio financings, hotel and resort financings and mortgage loans.
Malcolm’s clients include Citibank, Deutsche Bank, Banamex, Metropolitan Life Insurance Company and Shorenstein Properties.
Malcolm has published articles in The Real Estate Finance Journal, Real Estate Finance, and Pratt’s Journal of Bankruptcy Law. He has also published pieces for the American Law Institute and The Loan Syndications and Trading Association. Malcolm regularly speaks at industry seminars and conferences on real estate finance and related topics.

O’Melveny & Myers LLP has recently grown its real estate finance practice with the addition of Malcolm Montgomery to the New York team, joining in July 2023 from Shearman & Sterling LLP. Montgomery ‘s return to the firm has opened up its New York practice, largely advising lenders such as banks and REITs with real estate investment and transactions. The firm handles both financings such as multi-property secured loans, mezzanine financings, and construction financings as well as workouts and restructurings of real estate assets.
