Position

Nicolás Brause is a Partner in the Montevideo office, where he leads the Dispute Resolution team.

Career

He is strongly focused in Commercial litigation, especially Banking, Antitrust and Bankruptcy law thanks to his knowledge as an assistant professor of Commercial law in Universidad de la República. He regularly represents top-tier clients such as Banco Itaú, Google, Marfrig, Praxair, Barraca Deambrosi among others, and also has unique experience in high-profile litigation, as was the Pluna-case (Latin Lawyer´s 2017 Restructuring - Deal of the Year), of the recent successful closing of the Diamantis Plaza luxury residential building.

He also has vast experience in arbitration, under local or foreign regulation, both as lawyer and arbitrator appointed by the Uruguay´s Arbitration Chamber.

Experience Adidas: Counsel to the Adidas entities in the multimillionaire claim brought by the former local representative of the Reebok brand. Banco Itaú: Counseling in their corporate debt restructures both alone or syndicated with other banks, and counsel in bankruptcy matters and collections since 2007 to date, benchmark in this practice area. Google: Counseling in its ongoing right-to-oblivious claim, a leading case in Uruguay that would be a very valuable precedent for the upcoming legislation of this matter, in vogue in our region and worldwide. Barraca Deambrosi: Counsel in the judicial defense against the record-setting sanction imposed by our Uruguay´s Antitrust Authority, successfully achieving its annulment by our main State-affairs Tribunal, after a five-year long tough litigation. Main creditors in the bankruptcy proceeding of the state-owned airline Pluna: Almost single-handedly lead the settlement agreement within the multiple parties involved in this huge bankruptcy, for sure the biggest of our recent history, that Latis Lawyer deservedly awarded as Latam´s Restructuring Deal of the Year. Diamantis Plaza: led the successful closing of this high-quality residential complex, providing the unique solution to the multiple disputes between creditors and buyers, ending this long bankruptcy which enabled these luxury buildings to resume their original destiny. Arbitration: vast experience under local or foreign arbitration, also as arbitrator appointed by Uruguay´s Commerce Chamber.
