Position

James St.Ville is a barrister specialising in intellectual property and IT law, including patents, EPO oppositions, confidential information, registered designs, unregistered design rights, copyright, database rights, trade marks, passing off, trade libel, and IT and computer contract disputes many of which deal with complex engineering, electronics and software.  He is a chartered engineer with substantial experience of commercial electronics, optical communications and engineering research.  He has expertise in interim injunctions including search orders, Norwich Pharmacal orders, disk imaging orders, delivery up of source code, ex-parte injunctions to identify and deal with computer hackers, jurisdiction disputes, pre-action disclosure, third party disclosure, UK Border Agency seizures and disputes over letters of request and the examination of witnesses for the purpose of foreign proceedings.  Recent cases include Cabo v MGA (ongoing 2021 – alleged threats of patent infringement proceedings and breaches of competition law), Centek v Giles (2020 - breach of confidence, copyright and committal for contempt), TQ Delta v ZyXEL [2020] FSR 10 (CA) (SEPs and FRAND/RAND determination), Prosyscor v Netsweeper (2019 - internet authentication), Spin Master v PMS [2017] Bus LR 1627 (registered designs), Epoch v Character Options [2017] FSR 42 (water fusible polyhedral beads), Positec v Husqvarna [2016] Bus LR 714 (robotic lawn mowers), VPG v Air-Weigh [2016] FSR 4 (vehicle weighing) and Procter and Gamble v Star Global [2016] RPC 19 (parallel imports).
