Elizabeth accepts instructions in all areas of Chambers’ practice including: general civil, property, landlord and tenant, immigration, family, personal injury and crime.
Position
Before commencing pupillage, Elizabeth practised as a County Court Advocate and conducted over 450 hearings. Elizabeth accepted instructions in a wide range of matters, including: small claim disputes, landlord and tenant disputes, contested possession hearings, infant approvals and interim applications. Elizabeth also worked at a commercial estate agents in Kent, where she assisted in the negotiation of high value joint venture property development projects, landlord and tenant disputes, Housing Act notices and property licensing. Furthermore, Elizabeth accepts instructions for both defence and prosecution. Elizabeth has represented clients charged with various offenses. She has defended in road traffic offenses, raising arguments including special reasons and exceptional hardship. Elizabeth also has experience appearing in landlord and tenant disputes in the County Court, relating to possession and rent arrears. She has acted in forfeiture hearings. During pupillage, Elizabeth has had experience drafting opinions and pleadings relating to interests in land, landlord and tenant and housing matters. She has represented both Claimants and Defendants in contractual disputes, debt recovery claims and enforcement. She has made successful applications to strike out, for relief from sanctions, application to set aside and other interim applications. Elizabeth has also acted in road traffic cases, cases involving credit hire and MOJ Stage 3 hearings. She has advised on quantum and can provide advice in respect of liability and causation and draft pleadings. Elizabeth accepts instructions in all private and public family proceedings and has experience of handling cases involving domestic violence.
Career
Elizabeth joined Chambers in March 2019 and is developing a Civil and Commercial Practice. Elizabeth is an experienced advocate. Prior to pupillage Elizabeth was a County Court Advocate, her experience is, therefore, beyond her call.
Elizabeth is regularly instructed in a variety of Property and Commercial Disputes.
Property and Planning
Elizabeth has experience across the range of property issues from real property to landlord and tenant litigation. Elizabeth is often instructed to deal with issues involving leasehold matters, boundary disputes, and trusts of land. Elizabeth regularly provides advocacy in multi-day hearings, as well as, drafting advices, notices, pleadings and pre-action letters. Elizabeth's experience in property and planning includes:
Possession proceedings, including possession claims by mortgagees, LPA Receivers, Landlords and charge holders. Stays of warrants and writs. Adverse possession, Forfeiture Service charge and leasehold disputes, including breaches of leases. Rent repayment orders. Boundary Disputes. Drafting and making representations in respect of planning appeals. Tree Preservation Orders. TOLATA disputes. Enforcement of easements and covenants relating to land. Unlawful eviction. Tenancy deposits. Homelessness appeals. Disrepair. Injunctions, including anti-social behaviour injunctions and committals.Recent Cases
Successfully obtaining damages against a Local Authority in respect of disrepair in a Property following trial. Representation in a boundary dispute where damages were also sought pursuant to alleged breaches of the Party Wall Act Agreement. Advising a Leaseholder in respect of overpayments of service charge. Advising and acting for a tenant who had been unlawfully evicted. Drafted grounds of appeal for a s.205 Housing Act 1996 appeal, which resulted in the Local Authority resiling from their position.Commercial
Elizabeth has vast experience in commercial matters, in particular contractual disputes and insolvency.
Elizabeth's is regularly instructed to appear in insolvency proceedings for creditors, debtors, companies and office holders. Elizabeth has experience with: winding up and bankruptcy petitions, bankruptcy annulments and applications for orders for possession and sale.
Elizabeth's commercial work includes drafting of and interpretation of contracts, breach of contract and related claims, claims regarding the supply and sale of goods and services.
Education
Elizabeth achieved the highest mark in her cohort in her LLB degree and her success and contribution to the life of the University was recognised by the Law School who awarded Elizabeth three prizes. She went on to read for a LL.M, which had an emphasis on human rights.
