Katherine Fudakowski

Katherine specialises in the areas of employment and discrimination, personal and criminal injury and professional discipline. Katherine acts for both claimants and respondents in a wide variety of employment tribunal work including unfair and constructive dismissal, breach of contract, unlawful deduction of wages and all forms of discrimination claims. She has appeared regularly at case management discussions, pre-hearing reviews on jurisdiction issues and has experience of participating in judicial mediation. Katharine recently appeared in the Employment Appeal Tribunal in Walker v Church Mission Society, a case concerning the application of Lawson v Serco to an expatriate mission worker. Katherine has appeared in multi-day discrimination cases and has a particular interest in disability and pregnancy discrimination. Katherine undertakes both claimant and defendant work in personal injury cases. As an advocate she has quickly gained considerable experience of trials and applications in fast track and small claims matters in the County Court and regularly appears in interim applications on the multi-track. Katherine has good experience in the field of credit hire litigation, appearing regularly for both claimants and defendants. She has provided training to solicitors on the latest litigation tactics in this area. Katherine appears regularly in appeals against the decisions of the Criminal Injury Compensation Authority and has been successful in appealing CICA decisions on both eligibility and level of tariff award. Katherine attended internal disciplinary hearings and assisted in preparing for the case of R (on the application of Puri) v Bradford Teaching Hospital [2011] EWHC 970 (Admin), an application for judicial review of the decision to dismiss Mr Puri using a disciplinary panel consisting mainly of employees of the trust and to permit his appeal panel to be similarly constituted. Since then Katherine has acted as junior to Giles Powell in an application for an interim injunction to restrain an NHS Trust from proceeding with disciplinary proceedings in breach of contract and Article 6 ECHR.

St Catharine’s College, Cambridge (History – awarded the Lord Gooderson award for outstanding part II performance). During her graduate diploma in law and bar exams she won Lord Bowen, Wadham and Wolfson Scholarships from the Honourable Society of Lincoln’s Inn.
