Position

Ajmalul Hossain KC has vast experience of advocacy in complex and high-value cases in the High Court and Court of Appeal in London, in the High Court and Appellate divisions of the Supreme Court of Bangladesh and in domestic and international arbitrations and mediations. He has specialist knowledge of multi-party actions, cross-border disputes, recovery of debt and security, commercial frauds, regulatory and fiduciary obligation, and commercial documents and financial contracts. As A Hossain and Associates in Bangladesh, he highly rated by the Chambers Asia Guide and The Asia Pacific Legal 500.He acts as counsel for and against banks, financial institutions, corporations and others in complex litigation, arbitrations and mediations involving millions of pounds. Cases dealt with include claims arising out of transnational banking, trading, supply and financial contracts. His clients include solicitors, foreign lawyers and other professionals, several multinational and local banks, development and other financial institutions and companies.

Career

Qualified 1976; QC 1998; Advocate of the Bangladesh Bar 1977; Senior Advocate (Silk) 1998. Registered foreign lawyer and arbitrator, Singapore 2007. Cases include: representing Bangladesh as senior counsel in an ICSID arbitration held in London concerning a bilateral investment treaty dispute; senior counsel for corporate clients in several institutional and ad hoc arbitrations; sole arbitrator and co-arbitrator in several domestic and international institutional trade and ad hoc arbitrations; ICC arbitrations on contractual disputes concerning a $200m power project in London; a $100m contract for the supply of aircraft in Paris; a multimillion-dollar joint venture agreement for the production of pharmaceuticals in London; LCIA arbitrations as sole arbitrator of a $32m guarantee claim; with co-arbitrators on a substantial transport contract in London; acting with co-arbitrators in a $30 million SIAC arbitration in Singapore concerning waste disposal and power generation; acted for several hundred ex-employees of BCCI and others in the multimillion-dollar corporate insolvency of Bank of Credit and Commerce International in England, Luxembourg and the Cayman Islands; acted for the ex-employees in their claim against the Bank of England (the cases on behalf of the employees against the liquidators were settled in their favour under a package worth millions of dollars); several judgments of cases reported in the law reports of England and Bangladesh; advised and assisted in the setting up of subsidiaries, branches and representative offices of banks, financial institutions and companies in Bangladesh, UK, USA and the Middle East and several multimillion-dollar M&A transactions; provided expert opinions on laws of Bangladesh, India, Pakistan, England and the European Union; appeared in courts of North America, Europe and Asia and in arbitrations as an expert witness.
