How do you manage legal matters during periods of instability or crisis, and how does your legal strategy align with the overall business strategy to ensure the organisation’s resilience?
When we refer to organisational resilience, we mean the ability to overcome crises and continue with the company’s mission, which is to ‘provide comprehensive metallurgical solutions in manufacturing, construction, and assembly, adhering to rigorous standards of quality, safety, occupational health, and environmental protection, while carrying out our activities efficiently and innovatively within a framework of ethics and respect, contributing to the development of our surroundings’. To achieve this, during periods of instability or crisis, as in the case of Carlos Caballero, it is essential to make strategic and productive decisions while rigorously complying with applicable regulations related to current challenges. This also involves minimising future risks, which is why each business and legal strategy must strictly follow internal guidelines and the values we uphold, emphasising transparency and respect.
As a lawyer, my focus is on anticipating potential future risks by conducting a study of scenarios in which we can mitigate impacts through effective compliance with all applicable regulations. Once the analysis is complete, I present the most suitable strategy to the company’s management, and once a decision is made, all necessary mechanisms are implemented to achieve the objective, and we evaluate the outcomes after the crisis has been resolved. In other words, the legal strategy is aligned with the business strategy through strict legal compliance and adherence to the company’s core values, which enables us to overcome crises and ensure the continuity of our operations.
In your opinion, what are the key trends currently relevant in your country (they may be legal, political, economic, or business-related)?
Among the key current trends in Bolivia is the growing use of technology as an information source and, unfortunately, also as a vehicle for disinformation. This problem worsens when it is exploited by individuals seeking to fraudulently benefit by using the names and details of legitimate companies. The easy access to advanced technologies, such as apps, photo duplication, and the use of artificial intelligence, enables confusion and deception, particularly among those with limited technological knowledge, or even those with extensive knowledge who can be manipulated into providing personal information and funds in exchange for non-existent services supposedly offered by well-established companies. Our company has been affected by the misuse of our name and brand, causing harm to many individuals while financially benefitting those responsible for these actions. For this reason, it is crucial to implement security strategies that protect the company’s reputation by educating customers, suppliers, and employees about the risks posed by the illegitimate use of technology, ensuring they remain vigilant against potential fraud attempts, thereby safeguarding the integrity of the company and protecting those who trust in our business.
