How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?  

As in-house attorneys, we must act as business partners, thoroughly understanding the company’s lines of business, its various challenges, and objectives—not just the legal ones. This requires a deep comprehension of the applicable legal frameworks and how to navigate them effectively.  

Additionally, we must stay attuned to the constantly evolving context and its impact on the business. By doing so, we can provide advice that aligns with the company’s needs, mitigates legal and reputational risks, and that can even create new business opportunities. 

What are the main cases or transactions you have been involved in recently?  

With a talented team of in-house and outside counsels, and during various years, I led the litigation strategy, resulting in a groundbreaking ruling by the Supreme Court of Justice. This landmark decision acknowledged the human right to access technology and highlighted the need for updating obsolete legal frameworks.  

The ruling was issued in a complex unfair competition case brought by the incumbent industry against a disruptive technological business model proposed by the platform. This case not only set a significant legal precedent but also highlighted the evolving nature of legal challenges in the face of technological innovation. 

What emerging technologies do you see as having the most significant impact on the legal profession in the near future, and how do you stay updated on these developments?  

We are living in a constantly evolving technological landscape. Advanced Data Analytics, Artificial Intelligence (AI), and Blockchain are already impacting our daily lives and professions, even if we are not fully aware of their extent, and their influence will only continue to grow. 

Advanced Data Analytics can provide deep insights into legal trends, leading to more informed decision-making. AI offers tools that enhance efficiency in everyday tasks such as legal research, presentations, and various routine tasks. Blockchain provides enhanced security and transparency for transactions and aids in contract management through smart contracts and e-signatures. In the future, depending on legislative developments, blockchain could revolutionise notarised and public registry services, including real estate and corporate transactions. 

To stay updated in the field, I actively participate in webinars, conferences, and professional networks. I also subscribe to newsletters and legal tech publications and follow thought leaders in the industry. Fortunately, technology has made information more accessible, allowing us to stay informed through the internet. Well-managed and following responsibility principles, these emerging technologies will help us to increase efficiencies in the legal profession.
