How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?  

Especially in times of crisis, I approach management considering the risk resulting from each option presented or identified, to choose the most suitable one for the parties involved, supporting the organization is adaptability to these situations and contributing to ensuring that Clients feel calm and secure when dealing with us. At the same time, we develop strategies, documents and contracts adapted to the situation with a view to covering the entity if future claims and demands, adhering to the corresponding regulations and laws without losing sight of our international commitment to our external and internal clients and shareholders.  

 What are the main cases or transactions you have been involved in recently?  

I have been involved in banking claims, litigation processes (lawsuits) signs, sing of claims form transactional agreements, review of service, financial and adhesion contracts, as well as in the analysis of draft laws and various consultations on topics of: business, commercial strategies, human management, compliance with regulations, distinctive signs and protection of the user of the financial system. 

What measures has your company taken to embed sustainability practices into its core business operations, and how does the role of the general counsel contribute to driving and ensuring sustainable practices within the company?  

The measures we have taken to incorporate sustainability practices consist of alliance with organizations that are committed to the use of renewable energy, especially the installation of solar panels and water filtration and their consequent reduction in emissions, which are measure periodically. To confirm its effectiveness. 

We encourage the collection, separation of waste and recycling of garbage, with the installation of special trash cans, as well as conducting bottle and paper recycling operations and contests to motivate internal staff. In this sense, we conduct training incorporating topics related to the responsible use of natural resources. In our role, we actively take part in these activities, as well as concretize the commitment at the institutional level, at the same time, to include clauses in the contracts with our suppliers to record their commitment to these causes. As an entity we have a commitment to business ethics, compliance with laws and regulations, especially as a regulated entity. We are concerned about the impact that our operations may have on the economy, environment, people are rights, labor inclusion and social aspects. We take part in reforestation sessions, especially of endemic or endangered plants, in the construction of houses for low-income people in alliance with Techo RD, we hire personnel with other capabilities. The activities and many others contribute to publicising our commitment to the environment and to communities in need. 

  

Due to these commitments, we are among the five institutions in which branches have been certified in occupational safety and health, endorsed by the country is Ministry of Labour, Platilum Seal in gender equality, awarded by the Ministry of Women And UNDP, and RD Seal. INCLUDES by initiative in Inclusion and Diversity, Green Seal Truth and the international firm CO2Zero, Among others.  

In your opinion, what are the main trends that are salient in your country currently?  

Regarding the main trends in our country, I consider that they are limited to economic and business level, with the incursion into the so-called gig economy, with a tendency towards personal businesses as a sole or shared work activity with flexible and/ or remove work, very especially after the Covi.19 pandemic, as well as the incursion into businesses of young people who prefer to carry out liberal activity instead of limiting themselves to a schedule, supervision and a salary. In this sense, we cannot fail to include business development and growth based on technological advancement, which achieves process automation, the use of robotics to take advantage of the globalization of markets and their growth by being able to conduct negotiations and marketing by electronic means, use of digital signature.
