Managing legal aspects during periods of instability or crises requires a very proactive, adaptable, and risk-based approach. The legal strategy must be strictly linked to the overall business strategy of the group to ensure the organisation’s resilience to the instability or the crisis. 

How have you integrated technology into your legal processes, and what impact has this had on efficiency and compliance?  

The legal industry has undergone a significant transformation due to technological advancements and specifically: (i)document management systems: these systems streamline the organisation, storage, and retrieval of legal documents, improving efficiency and reducing the risk of errors; (ii) legal research databases: online legal research platforms provide rapid access to legal information, case law, and statutes, accelerating research and analysis; (iii) case management software: this software helps companies manage caseloads, deadlines, and client communications, enhancing organisation and productivity; (iv) artificial intelligence: AI tools can automate routine tasks, analyse legal documents, improving efficiency and accuracy; (v) cloud computing: cloud-based solutions enable secure access to legal data and applications from anywhere, enhancing collaboration and flexibility. 

What do you see as the major legal challenges for businesses in Italy over the next five years, and how are you preparing to address them?  

Given the specific and incredible dynamic of the Italian legal system, predicting challenges with precision is difficult (not to say quite impossible). However, based on current trends and potential legislative developments, some key areas of concern for Italian businesses over the next five years will include: 

Digital transformation and data protection: the rapid pace of digitalisation will continue to pose challenges related to data privacy, cybersecurity, and intellectual property rights. Compliance with the GDPR and emerging regulations will be crucial.��

Environmental sustainability and climate change: Increasingly stringent environmental regulations and expectations for sustainable practices will impact businesses across sectors. Companies will need to adapt their operations and supply chains to meet these challenges. 

Taxation and fiscal policy: tax reforms and economic policies can significantly impact businesses. Staying updated on tax laws and regulations, as well as potential changes in fiscal policy, is essential. 

Contractual disputes: economic fluctuations and geopolitical uncertainties may lead to an increase in contractual disputes. Efficient dispute resolution mechanisms and robust contract management will be crucial. 

Regulatory compliance: especially for the concession system where my company is operating, the complex regulatory environment (with potential new regulations, reforms and more) can create compliance burdens and influence the credibility and stability of the sector. Businesses will need to invest in robust compliance systems and training.
