How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?  

We recently established a dedicated function, risk and corporate governance, within the Legal department, which focuses on several key areas.

Firstly, we conduct proactive risk screening and identification. Relevant existing and upcoming regulatory changes are monitored daily via a third-party platform – an AI-powered, enterprise SaaS solution – covering the entire EEA, UK, Switzerland, and Turkey. The intelligence is tailored to our business case and provides all necessary details for further assessment, including the predicted likelihood that proposed regulations will be approved.

Secondly, we carry out enterprise risk assessment, mitigation, and continuity planning. For each identified matter, a comprehensive fact sheet is created, and all business divisions across Europe (12 in total, including business strategy, finance, product, and manufacturing plants) assess the risk of non-compliance with upcoming regulations. They also evaluate the potential impact of non-compliance on each operation, including the severity, likelihood, and necessary mitigation measures. This Risk Committee, organized and steered by Legal, defines the applicable methodology and ensures a uniform taxonomy across the business.

The third area focuses on communication. Once matters are identified and assessments are completed by all business divisions, they are submitted to relevant stakeholders globally. This initiates further residual risk assessments, the definition of risk owners, and the development of necessary mitigating measures.

Lastly, we monitor the implementation of decided mitigation measures. While implementation is carried out by the relevant risk owners – which can include Legal – the process is coordinated and monitored by Legal as the “project manager”. In addition, Legal plays a role in adapting the organization’s legal and compliance policies. This may involve updating contracts, strengthening risk management protocols, or revising crisis response strategies for the future.

Timely identification of emerging risks and their integration across all business units forms the basis for comprehensive reporting. This leads to prioritisation and action planning, ensuring risk mitigation and alignment with both Legal and business strategy. Furthermore, all intelligence results are shared across the organization, fostering a strong governance framework that enables quick decision-making, ensures compliance with corporate standards, and promotes a resilient organisational culture.

What are the main cases or transactions that you have been involved in recently?  

In 2024, I have been involved in several significant matters. One of the key projects was the establishment of the “Risk Management” function. This initiative, which took 12 months, involved defining roles and responsibilities across the organisation globally, ensuring that risk management is aligned with the company’s broader strategy.

    

Another major focus was Hyundai Connected Mobility, where we successfully set up a wholly owned subsidiary to centrally manage all European connected car services and subscription services. These services were previously handled by each local National Sales Company across Europe.

  

Lastly, the S-Project marked a pivotal step with the acquisition of the Swedish Hyundai importer. This acquisition led to the consolidation of the business into our franchise and the transformation of the existing retail network into a genuine agency network for the first time in Europe. 

  

What do you see as the major legal challenges for businesses in Germany over the next five years, and how are you preparing to address them?  

I believe everyone will agree that the regulatory environment will continue to evolve at a rapid pace. For instance, Germany and the European Union are placing increasing emphasis on climate change and sustainability, and we can expect even stricter environmental regulations in the near future. This includes the EU’s Green Deal and the CSRD, which will require companies to disclose more detailed information on their ESG practices.

Furthermore, data will become even more critical, and its processing will increase in complexity with advancements in AI, big data, and data enrichment, among others. On the flip side, the introduction of new digital regulations – such as the Digital Services Act (DSA) and the Digital Markets Act (DMA) – will impose additional requirements on companies.

In addition, it will no longer be enough to merely comply with new regulations and their requirements. It is vital to ensure alignment with all internal stakeholders, as these regulations could directly impact the company’s business strategy. Cross-functional alignment enables scenario-planning which is necessary to manage coming challenges successfully.
