How do you approach managing legal aspects during periods of instability or crises, and how does your legal strategy align with the broader business strategy to ensure the organisation’s resilience?
The key to managing legal aspects during periods of instability or crises is to ensure that the Legal department is strategically positioned as a business partner within the organisation. This strategic positioning allows Legal to be involved from the outset of all projects, crises, and changes within the business. Often, legal teams are only brought in at the end, which can result in mitigation rather than innovation or opportunity creation. It is imperative that the legal strategy is aligned with business goals, which is achieved by ensuring that the Legal department has a seat at the management table and is part of the decision-making team of the business.
During periods of instability or crises, it is crucial to have a proactive approach. This involves anticipating potential legal issues and addressing them before they escalate. This proactive involvement also allows for the identification of opportunities to innovate and create value for the organisation.
Furthermore, aligning the legal strategy with the broader business strategy ensures that the Legal department supports the organisation’s goals and objectives. This alignment is achieved through regular communication and collaboration with other departments, understanding the business’s needs and priorities, and providing legal solutions that are practical and effective.
What are the main cases or transactions you have been involved in recently (you don’t have to be too specific; we just want to know the work you’ve been doing in general terms)?
Successfully rolled out a non-discrimination policy that addresses the recognition of non-gender, non-binary identities, and the use of on-site facilities. This policy benchmarks best practices and ensures full alignment with local laws.
Achieved full compliance with the Companies and Intellectual Property Commission (CIPC) beneficial ownership requirements. This was the first instance of such compliance within the group, involving detailed reviews of foreign companies, trusts, and their compositions. Roll out of new Governance function within the SA entities to ensure better alignment with Companies Act and other legislative requirements.
