The Hudbay legal team of the South America business unit describes itself as a ‘multidisciplinary legal department’ and has a range of different specialisations amongst its members, with experience across both Peru and Chile. Daniel Torreblanca focuses on regulatory law, Raphael Aspillaga focuses on corporate law, Josefina Medrano focuses on compliance law, and Humberto Azaña acts as a paralegal and document controller. All four members report to the legal manager and compliance officer of the South America business unit, Luis Miguel Arce. Collectively, the legal team has not only consolidated a strong compliance program for the company, but has also successfully implemented software to manage the company’s legal obligations, including the implementation of alerts and reports. Heavily involved in corporate social responsibility, the legal team has also sponsored academic forums and congresses promoting education and culture in Peru. Additionally involved in litigation matters, in the past few years, the legal team participated in three international multimillion dollar arbitration disputes. Having significant contribution to the financial matters of the organisation, in 2017, Hudbay Perú entered into three leaseback agreements with Scotiabank, Banco de Crédito del Perú and Interbank for a total amount of approximately US$67m. ‘This transaction was aimed at replacing the existing financing granted by Caterpillar Leasing Chile in 2013 with a local financing which significantly reduced the costs involved in the loan’, explains Arce. Also involved in labour matters, most recently, in 2018, the legal team assisted Hudbay in reaching a mutually satisfactory agreement with its union in Peru which granted several labour benefits.
