What are the most significant cases or transactions that your legal team has recently been involved in?
More than a specific case or transaction, the most challenging thing in the last period has been to continue to contribute effectively to the corporate governance decision-making process, so that it adequately weighs up the dynamic economic, social, national, and international scenarios, where regulatory pressures and citizen scrutiny are gaining strength every day. We face a rapidly changing world, where technological advances and geopolitical conflicts raise questions and doubts that require us to be flexible in our dealing of them and agile in our legal considerations. Identifying the specific actions expected of us, regarding evolving regulatory and social standards, and contributing to their effective achievement is the greatest ongoing challenge.
How important is choosing to work with external lawyers who align with your company’s values? Are you likely to reconsider what firms you work with based on this?
Correctly choosing external legal support is vital in the development of the business. At Camanchaca we choose our external legal advisors based on their prestige and specific knowledge of the issues we face on a day-to-day basis. Being a public limited company listed on the Chilean Stock Exchange, whose line of business is fishing and aquaculture, and with a subsidiary, Salmones Camanchaca, listed on the Santiago and Oslo Stock Exchanges, our activity must deliver reports to different market, sectoral and environmental authorities, for which a high degree of specificity is required in the legal and technical knowledge of our advisors. This is highly relevant in selecting our external counsel, but it is also important that they converge with our goals of clear risk detection and a quick and appropriate response to them.
Why are in-house lawyers well-placed to drive change in their organisations?
The general counsel position is always balancing between various levels, between the board of directors, managers, and advisors, its mission is to contribute to decision-making. The general counsel knows how to assertively deliver advice that generates the greatest value for the company.
