What are the most significant cases or transactions that your legal team has recently been involved in?

We have been involved in the following major transactions:

The Coya BESS project, worth $160m, which will store renewable energy from the PV Coya Photovoltaic Plant, giving greater efficiency to the system, allowing a great amount of the PV energy to be shifted to hours when the revenue is higher and when grid lines are not overflowed.

The storage will be able to avoid losses due to curtailment and provide support for the Chilean grid. This project will have BESS (Battery Energy Storage System) technology and will use lithium batteries, supplied by Sungrow Power Supply. In addition, it will have a storage capacity of 638 MWh and will be one of the largest in Latin America.

We have also participated in project Mirasol, worth over $5m, and is being executed in the Dominican Republic. The services provided include the delivery of inverters for the Photovoltaic Park, commissioning, team training, and other services associated with the energization and operation of the Park.

As legal and contract manager, I led the negotiations to reach an agreement for my Company to take charge of these Projects and coordinated the negotiation meetings for the signing of the contracts to achieve better conditions for my company, higher profits, and include relevant clauses in benefit of renewability, sustainability, and environmental matters.

I ensured compliance with the contractual obligations, including but not limited to the delivery of the bank guarantees compliance with contractual milestones, and support in the legal and financial issues of the projects.

As we live in a fast-paced world today, what skills will a corporate legal team need to succeed in the modern in-house industry?

Understanding the company’s business, proficiency in multiple languages, staying constantly updated with legal knowledge, and building strong relationships with colleagues and clients are important skills to possess. A successful legal team in the modern in-house industry requires a multidisciplinary approach, gaining knowledge in diverse fields to provide effective legal counsel. Corporate legal teams should approach their work with passion and a sense of purpose. In promoting renewable energy and environmental sustainability, this commitment becomes even more significant.

Why are in-house lawyers well-placed to drive change in their organisations?

In-house legal professionals occupy an influential position within an organisation, serving as the vanguard in ensuring the organisation’s conformance with relevant legislation and regulatory standards, thus mitigating potential legal risks, and paving the way for sustainable business development. Their adeptness at problem-solving and conflict resolution serves as a bulwark against potential litigations and consumer disputes, contributing to enhanced organisational reputation.
