First, can you please give us an idea of the sort of work your team has done recently? 

The Humano Seguros legal team is in charge of all legal aspects related to the insurance activity carried out by the company, with in-house advice to all operational areas. From our area, the general conditions of all insurance policies marketed by the company are prepared, as well as all the complementary documents that are part of them, including particular conditions, annexes, endorsements, among other documents. We also work on the design and execution of the company’s defence strategy in the face of litigation and claims filed by insured parties and third parties, before the courts and before the Superintendency of Insurance of the Dominican Republic, empowering external lawyers if required, monitoring the approach to each topic.  

At the corporate level, we work on the preparation and registration of corporate documents that the company must keep updated as part of its operations, including assemblies, minutes of board and committee meetings, powers of attorney and delegations. We also manage the company’s extensive local and international portfolio of intellectual property.  

The legal team handles all the company’s contracts, from financial and investment issues, contracting of administrative and general services, contracting of technological licenses and computer developments, confidentiality agreements, real estate sales, rentals, among others.  

 

How do you stay up-to-date with changes in laws and regulations in the Dominican Republic relevant to your organisation’s industry? 

From the legal area of the company, we remain attentive to all the legislative initiatives that are deposited before the Chamber of Deputies of the Dominican Republic and before the Senate of the Dominican Republic, through periodic reviews. In the event that we identify any legislative initiative that directly or indirectly impacts the company, we analyse it and prepare a summary of it, which we in turn share with all areas of the organisation. In case of having comments or observations on the content of some of these documents, we take care of channelling them to the Legal Committee of the Dominican Chamber of Insurers and Reinsurers (CADOAR), an entity to which I belong as a permanent member, to prepare an agreed document, where as a union we express our position. Likewise, on occasions, we establish positions from the company, which we channel directly or through the business associations to which we belong.  

We also constantly monitor the publication of circulars, notices, regulations and other normative instruments in charge of our sectoral regulatory body, to analyse the impact and guarantee the timely implementation of its provisions by the company. We rely on an internal service for daily review of the written and digital press, which allows us to have a wide scope in the review of any issue that affects the business sphere, in tax, corporate, consumer or user protection areas, and protection of personal data.
