What are the most significant cases or transactions that you have recently been involved in? 

Advised a leading multinational company on devising and executing disciplinary procedures and litigation strategy in a case potentially involving organised fraud and labour disputes with employees.  

Advised on drafting petition in a case before the labour court, Criminal Courts for Corruption and Misconduct Cases, requesting the matter be considered by the labour Court. The court granted the request without delay.  

Assisted the company by leading an extensive research project into Thai criminal law and related legislation on immigration, migrant workers, and labour law, with the aim of identifying areas for improvement, exploring legal tools for labour case of human trafficking and related crimes, and assessing the standard of care provided for immigrants, migrant workers, child labourers, and so on.  

Advice the company on negotiating an alternative Dispute Resolution mechanism in a lease agreement, guarding against potentially prohibitive litigation expenses.  

Assisted in acquiring relevant data and documents to spur the court to revisit a computer or cybercrime matter labour case.  

Advised the regional office of company on dismissal of employees due to the company’s structural change, change conditions of employment. And handle Integrity undertaking and or corruption misconduct, theft, fraud offences  

Advised on the legal implications of employment termination in light of amended Labour Protection Act provisions on retirement.  

Worked on numerous cases jointly with the firm’s litigators to provide strategic advice to company on a broad range of civil and criminal cases, including labour disputes, fraud and white collar crime cases, corruption and misconduct offenses, commercial disputes,  Administration case and advice the employees family disputes. 

 

Which recent political, economic or regulatory changes have impacted your work the most in recent years? 

In the past, Thailand faced a pandemic-induced crisis, which led to a government announcement and curfew. The Labour Relations Act (LRA) was amended to require all labour disputes to be resolved through the Labour Relations Committee, rather than through strike or lockout. This meant that both parties lost their bargaining power and the ability to negotiate directly, effectively disrupting the labour relationship between employers and employees. 

In my opinion, labour disputes should always be resolved through mutual agreement between employers and employees, with the goal of maintaining a happy and harmonious workplace that benefits both parties. A stable and prosperous business environment can only be achieved when both parties work together to resolve their differences in a constructive and collaborative manner. 

 

How do you motivate and manage your legal team well?  

To be clear on visions and objectives and comply with the policy of company Teams need a sense of direction and some common objectives. Even if legal teams are working on different cases – so there’s no ‘one’ project or goal to unite the team – it’s important that everyone understands the bigger picture. Manage Team should provide regular updates on the organisation’s high-level business priorities. And our lawyers need to brief to colleagues on the context for the work. At a micro-level this is about setting clear goals and timelines. A shared sense of purpose is also about having common values supported by behaviours that bring those values to life. This isn’t about fluffy statements and vague aspirations. It’s about leaders and managers being clear about what they expect of their goal and what that looks like. and advice my team, every case regarding legal issue should be to determine for clearing overview point 360 C  

Moreover, Team meetings It’s important to get colleague together regularly so they know what’s going on and feel part of the group – and to avoid the silo effect. But team meetings need to have a purpose and be interesting, otherwise people will find them a waste of time, and even resent being there. 

 

Are the effects of AI on the legal world overplayed, or underplayed? 

I take a closer look at the impact of AI in my part of the legal world, I see it as useful but limited. 

I have also explored the ability of AI to produce initial drafts of legal documents. While it is true that working off an existing draft can often be more efficient than writing it from scratch, a crucial step in writing a legal document is to think about the structure of the document and use that thinking to organise the writing.  Language-based AI is especially challenging to simulate, and the industry might not be there yet. Currently, AI does not help very much with certain kinds of legal writing. Moreover, AI can’t proceed in lawsuit case in the court, currently the lawsuit case at court, use only human. If all lawyer use AI will be effects and/or conflicts in facts and/or fact of laws in case lawyer does not recheck.
