How do you address the management of legal aspects during periods of instability or crisis, and how does your legal strategy align with the overall business strategy to ensure the organisation’s resilience?
Managing a team in an entity undergoing liquidation has its complexities. We are talking about the definitive closure of a company (a bank) that was once large and trusted by financial consumers. The key is always to operate within the Financial Services Act and the current regulations issued by the regulatory authority. As a manager, you must be very aware of the regulations but also apply them in the context of the reality of the institution you are closing. Often, your strategies need to be tailored to the specific needs (“customised”) of the financial entity. This requires analysing the resources you have available—whether human, technological, or physical—and taking drastic measures in some cases, while being flexible in others.
What emerging technologies do you believe will have the most significant impact on the legal profession in the near future, and how do you stay updated on these developments?
Artificial intelligence is definitely having a notable impact worldwide. Machines and software that mimic human cognitive functions with tools such as learning or reasoning, as well as decision-making, are truly impressive. The legal field is undoubtedly the area most absorbed by AI; dealing with it and understanding its benefits is a challenge for every legal professional at the moment. Currently, I work with ChatGPT and feel that I am interacting with a robot that understands me perfectly.
How do you prioritise diversity and inclusion within your legal department, and what initiatives have you implemented to foster a more inclusive and equitable work environment?
Bolivia is a country with many diverse cultures and customs, which is also reflected in the work environment. For me, the best approach is motivation, working towards results, celebrating successes, and acting on early warnings always in a preventive or corrective manner. An important factor is the role of family and its significance in the development of the worker.
Can you comment on a particularly challenging dispute or M&A scenario you have faced and the innovative strategies you implemented to address it?
A company in liquidation usually tends to have a small staff (30 to 40) and strict institutional closure deadlines; however, the workload can sometimes be overwhelming. One of the innovative strategies I implemented at the intervened entity was to introduce an internship programme, which had never been practiced before. I established inter-institutional agreements with various local universities, and the results were satisfactory.
In your opinion, what are the main trends currently relevant in your country (these can be legal, political, economic, or business-related)?
There is a strong political trend, with pre-electoral pressure felt across various strata of Bolivian social life.
