How do you handle legal aspects during periods of instability or crisis, and how does your legal strategy align with the overall business strategy to ensure the organisation’s resilience? 

At MADISA, we manage legal aspects during periods of instability with a proactive and strategic approach. Our priority is to anticipate potential risks that may arise in a changing environment, closely aligning our legal strategy with the company’s corporate objectives and strategic goals. 

We constantly monitor the regulatory, economic, and political environment, which allows us to quickly adapt our legal strategies. We establish close collaboration with all our business units, with special emphasis on the financial area given the current economic situation. This approach enables us to understand the specific needs of each area and provide legal advice that not only mitigates risks but also supports MADISA’s growth, expansion, or transformation initiatives. 

In crisis situations, the management of legal aspects intensifies. Coordination with top management becomes crucial to quickly assess emerging legal risks, propose effective mitigation strategies, and ensure our responses are aligned with the company’s overall vision. 

This comprehensive approach allows us not only to protect MADISA from legal risks but also to identify opportunities that may arise in a challenging environment. By maintaining close alignment between legal strategy and business objectives, we significantly contribute to the company’s resilience and adaptability, strengthening its ability to successfully navigate periods of instability and emerge stronger from crises. 

 

What measures has your company taken to incorporate sustainability practices into its core business operations, and how does the role of the general counsel drive and ensure sustainable practices within the company?  

At MADISA, we understand sustainability as a fundamental pillar for our long-term growth and value generation for all our stakeholders. From the Management of Legal and Corporate Affairs, we have promoted several initiatives that directly contribute to this goal. 

One of our main measures is the strengthening of more sustainable risk management practices. This allows us to anticipate and mitigate risks more effectively, ensuring the continuity and sustainability of our operations. 

As General Counsel, my role is crucial to ensure that initiatives to strengthen sustainability not only comply with legal requirements but also align with our strategic objectives. We work closely with all business units to integrate sustainability considerations into our daily operations, from supply chain management to human resources practices. 

Our focus on sustainability not only helps us mitigate risks but also positions us as a responsible and forward-looking company, which is crucial for our continuous growth and resilience in a market increasingly aware of the importance of sustainable business practices. 

 

 

In your opinion, what are the main trends currently relevant in your country (they can be legal, political, economic, or business-related)? 

In Bolivia, we are experiencing several significant trends that are shaping the legal, economic, and business landscape: 

  1. Economic Challenges: The country faces a complex economic situation, characterised by inflationary pressures and complex challenges in currency management. This is leading the business sector to adopt more conservative strategies in terms of investment and expansion while seeking to optimise their operations to anticipate the impacts of the crisis. 
  1. Economic Diversification: There is a growing push towards the diversification of the Bolivian economy, seeking to reduce dependence on traditional sectors. We are experiencing an economic cycle shift, where the national industry is gaining significant competitive advantages. This is creating opportunities in new sectors, but also legal and regulatory challenges as new frameworks for these emerging industries develop. 

These trends are creating a dynamic and challenging environment for businesses in Bolivia. From a legal perspective, it is crucial to remain agile and proactive, anticipating how these changes may affect business operations and ensuring that legal strategies are aligned with these emerging trends.
