After his education at top universities in Brazil with speciality post-graduate studies in corporate law and business management from the Business School São Paulo and an MBA from Fundação Getulio Vargas (FGV) in 2010, Plínio Pistoresi worked in private practise in top tier Latin American law firms with a focus on litigation and arbitration. After a decade of experience, in 2017 he moved in-house as a senior legal manager (superintendente) at Banco Modal as the head of tax, labour and civil litigation, disputes, collection, restructuring, reorganisation, insolvency proceedings, arbitration, administrative proceedings, and advises the board of directors. In the last three years, Pistoresi has implemented a system to monitor lawsuits and administrative proceedings that allows the collection and analysis of information resulting in more accurate strategic decisions and lower costs. He has also instilled a closer relationship with external counsel to ensure they have complete knowledge of the business. Due to the difficulties the Brazilian economy has been through, the company has been exposed to several different kinds of litigation, from the traditional litigation in which banks are involved to speculation litigation. Because of this, Pistoresi says that the interaction among external counsels, the internal litigation team, the legal department, and the decision makers, is more important the ever. He identifies that it is important as an in-house lawyer to, ‘work as an oiled piece in a greater machine, not a piece [that is stuck in] the whole machine’. Adding, ‘acting as a safe harbour to management and staff really eases the daily challenges’.
