What are the most significant cases or transactions that your legal team has recently been involved in?
The Brazilian public prosecutor filed a class action to require that all motorcycle drivers registered in Loggi’s system be considered a Loggi’s employee and not an independent contractor. It’s the same discussion that involves Uber in many countries and Lyft in US, for example. Loggi was the first company to receive this kind of class action in Brazil. My legal team and I have worked hard in this case to present much evidence of the autonomy of these drivers and the absence of subordination to Loggi. We also presented studies from renowned institutes that show that drivers prefer to work as independent contractors and have higher incomes, since they were inserted in the e-commerce chain.
Last year, the Labour court decided in our class action that there is no employment relationship between Loggi and drivers. In other words, the Labour Court recognises that drivers and couriers are independent contractors. This was the first decision of a Labour Court in second instance in Brazil about this matter in a class action. In a nutshell, our decision is the most important case on labour aspects of sharing economy in Brazil, because the court analysed the sharing economy system and not only an individual case of a specific driver. Other companies have the same discussion, and our class action is the leading case in Brazil. This favourable decision benefits not only Loggi’s business and the 40,000 motorcycle drivers and couriers registered on our platform, but also the entire sharing economy ecosystem in Brazil.
Besides, in a natural movement when dealing with businesses that promote innovation, Loggi has an ongoing dialogue with public and private authorities, to present our business model and discuss public policies that defend and encourage innovation, autonomy, the generation of income, and social protection for digital economy professionals.
The part of my team that is fully dedicated to government relations and public policies has the mission of helping these stakeholders to understand this new disruptive business. We have had some good results such as a partnership with the city of São Paulo to help the mayor prevent traffic accidents involving motorcycles, for example. We really believe that working together, we will have better results for the whole society.
Loggi is a company committed to the democratisation of logistics, and does so by offering a fast, simple, and high-quality service to thousands of Brazilian residents, in addition to generating a positive impact on our entire ecosystem. And my legal team has an important contribution to this mission, as we collaborate to build Loggi’s business model, participate on dialogues with public and private authorities and defend our business in case of any dispute.
This is the strategy I built to deal with this matter and I’m very proud of the results. But I know that my colleagues are also responsible for all this success because they believe in this disruptive business and built and implemented the strategy with me. We are 18 lawyers, 70% are women, representing the Brazilian diversity, in region, gender, ethnicity, or sexual orientation, facing the challenge of connecting Brazil and very proud to be part of this transformation in our country.
