Maersk, the international shipping company, is a force within the Chilean legal market. She joined Maersk in February 2017 covering the West Coast of South America, which includes Chile, Peru, Ecuador and Bolivia. Originally getting her start at CCNI, a Chilean shipping company acquired by Hamburg Sud in 2015, Emilfork began as an intern in the claims unit. Over time she was promoted as in-house legal counsel based in Santiago. Within her time at CCNI, she participated in redrafting the bill of lading, in major arbitration cases and had close commercial relations with P&I clubs. In 2009, she was headhunted as risk director for the National Oil Company (ENAP). After a few years handling major claims such as the February 2010 earthquake property case, pollution liability cases, as well as handling the renewal process for one of the most complex insurance programs in Chile, she moved to Marsh and Aon where she further developed experience in risk management working at insurance brokers with a client portfolio that included Codelco, Arauco, CMPC, Quiñenco, amongst other large corporate accounts. After years of working away from the maritime industry, she returned to her shipping origins joining Maersk. During her tenure at Maersk, Emilfork highlights that it has shifted from a traditional shipping company – transporting containers in vessels – to a leader in container logistics operation. She says that, ‘this has meant a massive challenge in terms of working within a wider scope of activities, different liabilities and basically reinventing myself. Today, we have to deal with many other products and provide swift and helpful legal advice regarding customs house brokerage, warehousing, trucking, amongst other logistics services’. In December 2017, the company acquired Hamburg Sud, a major acquisition of one of the leaders in the maritime industry on a worldwide scale involving investigations from competition authorities in several jurisdictions and liaising with a cross functional team in all continents. She also worked on the recovery after the Maersk cyber attack which crashed the company’s systems for approximately one month. She highlights that ‘this led the entire organisation to reinvent ourselves and go back to basics to resolve the issue and to continue doing business. This brought us closer and made us innovate and become creative from all points of view’. Emilfork expertly leads a diverse team in terms of background, ethnic and gender composition, and serves as part of the executive board bringing her commercial and international experience to bear as a voting member in all company decisions. Her insight, perspective, skill and drive all make her an excellent legal manager.
